This Terms of Service (this “Agreement”, “Terms”) is between SITELIUM.COM (“we”, “us”, “System”, “Platform”, “Sitelium.com” or "Sitelium") and the person (“you”, “User” or “Customer”) using our services (“Services” or "Service").

We provide you with access to our System that helps you create websites, manage their content and customisation as well as hosting services. Listed below are the terms and conditions of using our Platform.



Welcome to Sitelium!

These Terms of Service ("Terms") govern your access to and use of the Sitelium platform (“the Platform”), including its website builder, templates, cloud hosting, integrations, support tools, documentation, and any other related products or services that reference or link to these Terms (collectively, the "Services").


By accessing or using the Services, you agree to be legally bound by these Terms, forming a binding agreement between you and SITELIUM.COM ("Sitelium", "we", "us", or "our"). If you do not agree to all of these Terms, you must not access or use the Services.


Our Data Processing Addendum is hereby incorporated into and made part of these Terms for users subject to GDPR or similar privacy laws.

Overview

Sitelium provides a no-code website building platform that enables users to design, build, and publish websites via a visual editor, with optional integrations for hosting and third-party services. Sitelium also offers tools for managing leads, form submissions, and integrations with marketing and analytics platforms.


You may use the Services to create and manage websites for personal or commercial purposes. Users may be granted access via invitations or create their own Sitelium account.


By using the Services, you agree to comply with these Terms as well as our Privacy Policy and Data Processing Addendum, which explain how we collect, use, and protect your personal information and content.


You may use Sitelium only if you have the legal capacity to form a binding contract and are legally permitted to use the Services in your jurisdiction. Use of the Services by anyone under the age of 16 is strictly prohibited.


These Terms constitute a legally binding agreement between SITELIUM.COM and its affiliated entities (“Sitelium”, “we”, “us”) and you in connection with your access to and use of any Sitelium Services. Please read these Terms carefully before using our platform or any of our related tools, integrations, or offerings.


You may access or use the Sitelium platform and Services only if you fully agree to these Terms. By registering, creating a website, accessing your account, or otherwise using any Sitelium Services, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as any additional legal documents that may apply to your use of Sitelium, including our Privacy Policy and Data Processing Addendum.


If you do not accept or understand these Terms, or if you do not have the legal authority to enter into a binding agreement with Sitelium, you must immediately discontinue use of all Sitelium Services.


Please note that if you are using Sitelium as part of an agency freelancers arrangement, you are solely responsible for your clients’ use of any websites created using our platform. Sitelium does not assume any responsibility for representations made by you to your clients, nor does it accept liability for the content, structure, or compliance of websites built or maintained by you.


By using our Services, you also acknowledge that you have read and understood our Privacy Policy, which describes how we collect, use, and protect your personal data.


We may update or modify these Terms from time to time without prior notice. The latest version will always be available via the “Terms of Service” link on our website. By continuing to use the Services after changes are made, you agree to the revised Terms. If you do not agree with the updated Terms, you should stop using the Services.


If you violate these Terms, Sitelium reserves the right to suspend or terminate your account, restrict your access to the Services, or take any other action permitted by applicable law.

I. Using the Services

1.1. Eligibility and Authority

You may use the Sitelium Services only if you are at least 16 years of age and have the legal capacity to form a binding agreement. By accessing or using our Services, you represent and warrant that you meet these requirements. If you are under 18, you must have the consent of a parent or legal guardian to enter into this Agreement, and they must review and accept these Terms on your behalf.


1.2. Service Changes and Access

We reserve the right to modify, suspend, or discontinue parts or all of the Services at any time, with or without notice. This may include changes to features, account eligibility, or available templates. We are not responsible for any losses or damages resulting from such changes.

II. Creating an Account

2.1. Signing Up


To access and use many parts of the Sitelium Services, you must first create a Sitelium account (“Account”). To register, you must provide a name, a valid email address, and a password, and you agree to these Terms, our Privacy Policy, and our Data Processing Addendum. You may also be asked to verify your email or identity in certain cases.


2.2. Account Ownership and Responsibility


The email address used to create the account is considered the official owner of the account. This user has the authority to manage the account, request changes, and receive support through our support team, as well as our help center's knowledge base documents and video tutorials.


2.3. Unique URLs and Website Creation


When creating a site through Sitelium, you will be assigned a unique Sitelium URL for each website. You are responsible for the security, content, and management of each site associated with your account.


2.4. Account Security


You are solely responsible for all activities that occur under your Account, and for maintaining the confidentiality and security of your password and login credentials. Sitelium will not be held responsible for unauthorized access, account misuse, or data loss due to your failure to secure your credentials. If you suspect that your account or password has been compromised, you must notify us immediately at support@sitelium.com.


2.5. Account Integrity


You agree to provide accurate, complete, and up-to-date information when creating and maintaining your account. Sitelium may suspend or terminate accounts that are based on false, misleading, or fraudulent information, or that violate these Terms.


2.6 Account Inactivity


Sitelium reserves the right to delete free or inactive accounts, including associated websites and content, after a period of prolonged inactivity (12 months), without any notice.

III. Your Content

3.1. Ownership of Content


When you use the Sitelium Services to create websites or digital assets, you retain full ownership of all content you upload or create (“User Content”), including but not limited to images, videos, audio files, logos, fonts, text, design elements, code, and any other materials. Sitelium does not claim ownership of your User Content.


3.2. License to Operate the Service


By uploading or integrating User Content into Sitelium, you grant Sitelium (and our third-party service providers acting on our behalf) a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, store, modify, display, and distribute your User Content, but only to the extent necessary to:


  • Host, publish, and maintain your websites;
  • Provide you with technical support;
  • Improve and secure the Services;
  • Enforce our legal rights under these Terms.
  • This license is solely for the limited purpose of delivering and enhancing the Sitelium Services and does not transfer ownership of your intellectual property.


3.3. Prohibited Content


You agree not to upload, post, share, or use Sitelium to distribute any content (or to build any website) that:

  • Promotes or incites physical, psychological, or emotional harm to people or animals;
  • Exploits or targets minors in any way;
  • Contains obscene, sexually explicit, harassing, defamatory, or invasive material;
  • Encourages hate speech, violence, or discrimination based on race, gender, nationality, religion, disability, sexual orientation, or age;
  • Includes misinformation, false claims, scams, or deceptive content;
  • Promotes illegal activities or regulated products without proper disclosure;
  • Violates any intellectual property rights or publicity/privacy rights of others;
  • Shares confidential information without proper authorization;
  • Threatens democratic institutions or encourages harmful societal disruption;
  • Otherwise violates applicable laws or regulations.


3.4. Responsibility for Your Content


You are solely responsible for the integrity, legality, and backup of your content. Sitelium does not monitor the content of your website(s), and we are not liable for any damages resulting from content loss, corruption, or unauthorized access. It is your obligation to regularly back up your materials.


3.5. Content Removal and Enforcement


Sitelium reserves the right, but not the obligation, to monitor content uploaded to or published via our Services. We may remove, restrict, or delete any content (or suspend or terminate your account) if we reasonably believe it violates these Terms, applicable laws, or our community standards. We are not liable for any resulting loss of content or disruption of service.

IV. Your Responsibilities

As a Sitelium user, you're responsible for everything you create, upload, or publish using the Sitelium Services. By using the platform, you confirm that your content, websites, and activities are lawful and in line with these Terms. Please use Sitelium responsibly and ethically, especially when representing content to your end users or clients.


4.1. Only Use Content You Have Rights To Use


You represent and warrant that you either own all rights to your User Content or that you have the necessary licenses, consents, and permissions to upload, publish, and use such content through the Sitelium Services. This includes (but is not limited to) images, videos, code, logos, fonts, and written content. You further confirm that our use of your User Content, as permitted under these Terms, will not infringe or violate any third-party rights, including intellectual property, privacy, publicity, or contractual rights.


Do not copy, use, or upload any content to Sitelium unless you are legally authorized to do so.


4.2. Comply With Applicable Laws


You agree to use Sitelium in accordance with all applicable local, national, and international laws and regulations, including those relating to data protection, consumer rights, sanctions, and export controls. You must not use Sitelium to conduct, support, or promote any illegal activity.


4.3. Be Mindful When Sharing Content


Websites and content created with Sitelium may be accessible via the public internet or shared through third-party platforms. You are solely responsible for ensuring that any information you make public is appropriate and lawful. Sitelium is not responsible for the consequences of content you choose to distribute or publish.


4.4. Respect Our Acceptable Use Policy


You agree that your use of the Sitelium Services and your User Content complies with our Acceptable Use standards. This includes prohibitions on harmful, fraudulent, harassing, illegal, or misleading content. If you breach these standards, Sitelium reserves the right to suspend or terminate your account or remove offending content, as described in these Terms.


4.5. Your Custom Code Is Your Responsibility


Sitelium allows users to add custom HTML, CSS, JavaScript, and third-party integrations to enhance their sites. Any such customizations are considered part of your User Content. You are solely responsible for ensuring that your code:


  • Does not harm or impair Sitelium’s platform or services;
  • Is secure and free from malware or vulnerabilities;
  • Does not violate any applicable laws or third-party terms;
  • Functions as intended and does not interfere with platform performance.


Please note that Sitelium does not provide support for troubleshooting or debugging custom code. You should only use this feature if you have the required technical knowledge.

V. Content and Ownership

5.1. Your Intellectual Property


As between you and Sitelium, you retain full ownership and intellectual property rights to all User Content that you create, upload, or integrate using the Sitelium Services. This includes but is not limited to: images, videos, audio files, fonts, logos, icons, illustrations, artworks, compositions, text, custom code, animations, designs, templates, branding elements, business data, APIs, and any content you or your end users submit or host via the platform.


Sitelium does not claim ownership of your User Content.



However, by using the Services, you grant Sitelium a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable license to host, use, store, display, reproduce, copy, distribute, and adapt your User Content solely as necessary to:


  • Provide, maintain, and improve the Services;
  • Operate backups and disaster recovery systems;
  • Make formatting or performance adjustments (e.g., resizing images, adapting to screen sizes);
  • Facilitate platform security and compliance processes;
  • Display your websites and related assets to you, your clients, or their end users;
  • Train internal tools and features (e.g., automated layout suggestions, responsive design models), to the extent permitted by law.
  • This license exists only for as long as you use the Services and ends when your User Content is deleted or your account is closed, unless retention is required for legal or technical reasons.
  • You own your content. We just use it to run the platform smoothly.


5.2. Sitelium’s Intellectual Property


All rights, title, and interest in and to the Sitelium platform, its software, templates, visual elements, backend systems, dashboards, and technology infrastructure — including but not limited to all source code, APIs, algorithms, databases, interface designs, visual themes, layout frameworks, documentation, UX flows, service tools, scripts, logos, trademarks, domains, and proprietary know-how — are and will remain the exclusive property of SITELIUM.COM or its licensors (collectively, “Sitelium IP”).


Subject to your full compliance with these Terms and the timely payment of any applicable fees, Sitelium grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Sitelium platform and Services for the purpose of building, hosting, and managing websites through your Sitelium account or for your clients.


This license does not grant you any ownership or interest in Sitelium IP or any of its components. You agree not to:


  • Modify, copy, distribute, sell, license, or publish any part of the platform;
  • Reverse engineer or decompile Sitelium software;
  • Use Sitelium’s tools or content in a way that competes with Sitelium.
  • Some fonts and visual assets available through Sitelium may be licensed from third parties. You are responsible for reviewing and complying with the applicable license terms for such third-party assets.

You use the platform; we own the platform.


5.3. Templates and Demo Content


Sitelium provides a collection of design templates, layout blocks, overlays, and demo content (collectively, “Templates”) to help you build and visualize websites. These Templates may include placeholder text, stock imagery, graphics, or branding elements ("Demo Content").


Unless explicitly allowed, you may not:


  • Use Demo Content in a live or published website;
  • Redistribute, copy, or extract Templates or Demo Content for use outside the Sitelium ecosystem;
  • Use any Sitelium Templates in a competing product or service.


All Templates and Demo Content remain the exclusive property of Sitelium or its licensors and are licensed to you only for use within the Sitelium platform and under the conditions of these Terms.


5.4. Beta Features and Early Access


Sitelium may, from time to time, release beta, experimental, or early access features. These features are provided for testing and feedback purposes and may be unstable, incomplete, or subject to change without notice.


By using beta features, you acknowledge that:


  • Sitelium provides no guarantees as to functionality, security, or availability;
  • These features may be modified or withdrawn at any time;
  • Support for beta services may be limited or unavailable.
  • Use of beta features is entirely at your own risk.

5.5. Feedback and Suggestions


If you submit any ideas, suggestions, feedback, feature requests, improvements, or any other input related to Sitelium or its Services ("Feedback"), you acknowledge that:


  • Sitelium exclusively owns all rights to such Feedback;
  • You irrevocably assign any rights you may have in that Feedback to Sitelium, including intellectual property rights;
  • Sitelium may use, adapt, publish, share, implement, or commercialize the Feedback without acknowledgment, attribution, or compensation to you;
  • You waive any and all current or future claims to moral rights, attribution, or approval regarding the use of your Feedback.



Feedback may be used by Sitelium for purposes including, but not limited to:


  • Improving the platform or developing new features;
  • Conducting customer research and product testing;
  • Creating insights, benchmarks, or usage analytics (including aggregated data);
  • Communicating with you or others regarding Sitelium updates;
  • Ensuring platform security and performance;
  • Complying with legal or regulatory obligations.



You represent that your Feedback is truthful, lawful, and does not infringe on any third-party rights.


5.6 Sitelium’s Rights and Platform Control


Sitelium provides a website-building system that includes access to customizable templates (themes), visual design tools, hosting via third-party providers, and content delivery network (CDN) services. While some mockup themes may include stock images, Sitelium does not claim ownership over those third-party assets and provides them solely for illustrative or placeholder use.


We reserve the right, at our sole discretion, to modify, suspend, or discontinue any part of the Services, including features, templates, hosting capabilities, or eligibility criteria, at any time, without notice or liability. This includes our right to suspend or terminate access to your account or specific features of the platform if we determine you are in breach of these Terms or other applicable policies.


All published websites on Sitelium are automatically issued HTTPS certificates for secure access. You may not disable or remove HTTPS functionality; certificates are assigned by default to any domain connected through Sitelium to ensure best practices in web security and encryption.



VI. AI Services

As part of the Sitelium platform, we may offer access to artificial intelligence tools and features that automatically generate or pre-populate website structures, sections, and content to assist you or your clients in building sites more quickly (the AI Services). These features may, for example, create draft pages, headlines, text blocks, or layout suggestions based on basic configuration choices (such as industry, topic, or language), your existing content, or information gathered from public sources, including search engines.


Some Sitelium features may include AI-generated content or suggestions to speed up your design process. You remain fully responsible for reviewing and deciding whether to keep, modify, or delete any such AI-generated content.


AI can help you start faster - you still decide what stays on your website.


6.1. Automatically Generated Content


The AI Services may generate draft websites or content by combining:


predefined templates, layouts, and components made available by Sitelium


your existing content, such as your project settings, domain, logo, or text you add to the platform


information obtained from publicly available sources, including search engines, to suggest generic business descriptions, headings, or similar text



You acknowledge that:


  • AI-generated content is automatically produced and may not be accurate, complete, original, or suitable for your specific use
  • similar or identical content may be generated for multiple users
  • AI-generated content may contain errors, outdated information, inappropriate statements, or references to third-party brands, products, or websites

You are solely responsible for carefully reviewing, editing, and validating all AI-generated content before using, publishing, or displaying it on any website, and for removing or modifying any part that is incorrect, misleading, infringing, or otherwise unsuitable.


6.2. Accuracy, compliance, and risk


AI technology is inherently probabilistic and may generate content that is imperfect or inappropriate for your particular context. Accordingly, Sitelium does not and cannot guarantee the quality, legality, originality, intellectual property compliance, bias neutrality, or fitness for any particular purpose of any AI-generated content.


You are responsible for:


  • ensuring that all published content on your websites, including AI-generated content, meets your legal, regulatory, contractual, and internal policy requirements
  • informing your clients and end users (where applicable) that parts of the website may have been generated or assisted by AI and should be reviewed before reliance
  • verifying that AI-generated content does not infringe third-party intellectual property rights, misuse trademarks, or violate any applicable laws or industry-specific rules, including those related to marketing, consumer protection, health, finance, and privacy

Sitelium disclaims all liability for any consequences, claims, losses, or damages arising from or related to your reliance on, or publication of, AI-generated content.

6.3. Ownership of content


Any content, data, or material you upload or configure in the Sitelium platform, including your logos, texts, images, and project settings, is treated as your User Content under these Terms.


As between you and Sitelium:


AI-generated content that you choose to keep, use, or publish on your websites will also be treated as your User Content, subject to any third-party rights that may apply

Sitelium does not claim ownership over such content, except where it incorporates Sitelium’s own templates, components, or other pre-existing intellectual property, which remain the property of Sitelium or its licensors

You are responsible for ensuring that your use of any AI-generated content complies with Section 5 and with all applicable intellectual property and content rules.



6.4. License to Sitelium for AI services


To operate, secure, and improve the AI Services and the Sitelium platform, you grant Sitelium a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable license to:


  • store, process, and display configuration data, draft websites, and AI-generated content within your account and projects
  • analyze how AI-generated content and related features are used in order to maintain, test, and improve the performance and reliability of the AI Services, to the extent permitted by law
  • share such data with approved third-party service providers or subcontractors strictly for the purposes of providing, supporting, or enhancing the AI functionality

Sitelium may review AI-related activity for legal compliance, abuse prevention, security monitoring, and troubleshooting. Any processing of personal data within the AI Services will be handled in accordance with our Privacy Policy and applicable data protection laws.

6.5. Third-Party AI Providers


Some AI Services may be powered by third-party providers, and your use of these features is subject to their respective terms and privacy policies, which may be updated independently of Sitelium. By using Sitelium’s AI features, you agree to comply with any applicable third-party terms and to inform your end users (if applicable) of their obligations when interacting with AI-generated content.

VII. Fees and Subscriptions

7.1. Paid Services and Subscription Plans


Certain features of the Sitelium platform are made available as Paid Services under monthly and yearly subscription plans. By signing up for a paid plan, you agree to pay all applicable fees (“Fees”) as outlined at the time of your subscription or upgrade.


Sitelium offers:

  • Yearly subscription options for Sitelium
  • Free account tiers, which may be terminated at any time at Sitelium’s sole discretion


All Fees are billed in advance of the applicable billing period and are non-refundable except as expressly stated in these Terms or required by applicable law.


Sitelium reserves the right to modify, suspend, or terminate Free accounts or delete content from Free accounts at any time, with or without notice. Sitelium disclaims any liability for loss of content from Free account websites.


7.2. Payment Terms


All fees for access to Sitelium’s Paid Services are stated in United States Dollars (USD) and are exclusive of any applicable taxes, including but not limited to sales tax, value-added tax (VAT), goods and services tax (GST), or any other applicable charges imposed by governmental authorities. These taxes are your sole responsibility and will be added to the total amount due where required by law.

Pricing Structure and Tailored Offers

Sitelium provides access to Paid Services via standard subscription tiers as published on the Website. In certain cases, Sitelium may offer customized plans or individually negotiated pricing (collectively, "Tailored Pricing") for specific customers, agencies, or enterprise users. Tailored Pricing must be documented in writing and approved by Sitelium. Unless otherwise specified in writing, all terms applicable to standard pricing plans also apply to Tailored Pricing agreements.


By subscribing to a standard plan or accepting a Tailored Pricing offer, you agree to pay the amount shown at the time of purchase or as specified in your tailored agreement. You further acknowledge that pricing may vary based on selected features, usage levels, service locations, billing frequency, or promotional discounts, and that Sitelium reserves the right to revise its pricing at any time. However, any pricing change will only apply prospectively to future billing cycles and will not affect fees for ongoing subscriptions unless otherwise agreed in writing.


Billing and Payment Authorizations

Payment for Paid Services is due in advance and must be processed through Sitelium’s approved third-party payment providers. By submitting your billing information, you authorize Sitelium and its designated processors to (a) charge the total fees, including recurring subscription amounts and applicable taxes, to your selected payment method, and (b) store your payment information securely for automated renewals or future transactions.


For recurring services, your selected subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date, in accordance with Section 7.3. If you upgrade your subscription, the difference in fees will be charged immediately on a prorated basis. If you downgrade or cancel your subscription, the change will take effect in the next billing cycle unless explicitly stated otherwise.


Responsibility for Payment

You are solely responsible for ensuring the accuracy and validity of your billing information, including maintaining an active and funded payment method. If a payment fails, is reversed, or is rejected for any reason, Sitelium reserves the right to:


Immediately suspend or terminate access to Paid Services;

Re-attempt the payment method on file;

Request updated billing credentials;

Initiate collection proceedings for unpaid fees, including interest and legal costs where permitted by law.


Failure to remit timely payment may also result in the loss of promotional rates, discounts, or access to legacy pricing structures.



Confirmation and Invoicing

Upon successful processing of payment, Sitelium will issue an electronic receipt or invoice to your registered email address or billing dashboard. This documentation will serve as official confirmation of payment and may include tax identification numbers or other invoicing requirements upon request.


7.3. Auto-Renewals and Cancellation


To prevent interruptions, Paid Services are set to automatically renew at the end of each subscription term for the same duration (e.g., monthly or annually), unless you explicitly cancel before the renewal date. You can cancel auto-renewal by contacting our support team at least 24 hours prior to the renewal period.


If not canceled in time, your subscription will renew at the then-current fee. Discounted or promotional prices may revert to full standard rates after the initial promotional term ends.


You may cancel your Paid Services at any time; however, unless a refund is expressly provided, your cancellation will take effect at the end of the current subscription period. No partial refunds are given for unused portions of paid terms.

7.4. Refunds


We want you to be completely satisfied with your subscription. Our policy is designed to be clear and transparent about refunds related to our free trial and paid services:


Free Trial and Subscription Commitment

We provide a comprehensive 14-day free trial that allows you to experience all the features and functionality of our service without requiring any payment information upfront. This trial period is designed to help you determine if the product meets your needs and expectations.


By subscribing to a paid plan after the free trial, you acknowledge that you have had a sufficient opportunity to assess the service and are satisfied with it.


Non-Refundable

All sales and subscription fees paid after the free trial period are final and non-refundable.


We do not offer refunds, credits, or prorated reimbursements for any reason, including but not limited to:

  • Partial billing cycles or unused subscription time.
  • Changes of mind or if the service is no longer needed.
  • Dissatisfaction with the service after the free trial period has ended.
  • Inability to use the service due to user-side technical issues that are not a result of a fault with our product.


Subscription Cancellation

You may cancel your subscription at any time by contacting our customer support team via support@sitelium.com.


Upon cancellation:

  • Your access to pro features will continue until the end of your current paid billing period.
  • No further charges will be made after the current billing period expires.
  • To avoid being charged for a renewal, you must cancel your subscription before the renewal date. We send a renewal reminder email two days before subscriptions are charged. We do not issue refunds if a cancellation is made after the renewal charge has been processed.



7.5. Chargebacks


If you initiate a chargeback with your bank or credit card company for a fee legitimately charged by Sitelium, this will be considered a breach of your payment obligations. Sitelium reserves the right to:


  • Immediately terminate or suspend your account
  • Permanently restrict re-registration
  • Delete all content associated with your account



You will remain liable for all outstanding fees, as well as any dispute-related expenses incurred by Sitelium. We strongly encourage you to contact our support team first before initiating a chargeback.


7.6. Third-Party Payment Processors


Sitelium uses third-party payment processors (e.g., Paddle, PayPal) to process payments. Your payment information is handled in accordance with those providers’ respective terms and privacy policies. Sitelium disclaims any liability related to such third-party processing and is not responsible for additional bank fees, currency exchange charges, or cross-border transaction costs.



7.7. Fair Use and Reseller Responsibility


You agree to use the Services fairly and within reasonable bandwidth, storage, and API limits applicable to your subscription. Excessive or abusive use may result in account restriction or additional charges.


If you are a Reseller or Agency, you are solely responsible for managing client accounts, payments, and terms with your customers. Brizy is not liable for client service disputes, subscription misuse, or support expectations arising from white-label usage.



7.8. Special Offers and Promotions


From time to time, Sitelium may make available limited-time promotions, discounts, trial periods, sales campaigns, or other special offers (collectively, Promotions). All Promotions are subject to these Terms and any additional conditions presented on the relevant promotional page or communication. In case of conflict, the specific conditions of the Promotion will prevail for the duration of that offer.


Promotions are available only for the period explicitly stated and may be modified or withdrawn at any time. Availability may be limited by factors such as geographic region, eligibility criteria, account status, or usage restrictions. Unless expressly indicated, Promotions apply only to new purchases and do not affect existing subscriptions, renewals, Tailored Pricing agreements, or previously applied discounts.


Participation in a Promotion does not guarantee future pricing, discounts, or continued access to the same terms once the promotional period ends. Any Fees payable after the end of a Promotion will revert to the applicable standard rates unless otherwise specified in writing.



7.9. Service levels and exclusions


Unless you have entered into a separate written service level agreement (SLA) signed by Sitelium, the Services are provided on a commercially reasonable efforts basis only. No uptime guarantees, performance commitments, service credits, priority support, or remedies of any kind apply to your subscription. Any descriptions of availability, maintenance practices, or support responses are for informational purposes and do not constitute binding service levels or contractual commitments.

VIII. Third-party services and integrations

Sitelium works with trusted third-party service providers to deliver core parts of the Platform, including hosting, analytics, payments, email delivery, AI content generation, design tools, and optional integrations made available through the Services (Third-Party Services). These providers operate under contractual obligations consistent with applicable privacy and security laws, as described in our Privacy Policy. However, Sitelium does not control or endorse the terms, availability, performance, or practices of these Third-Party Services, and your use of them is at your sole discretion and risk.


8.1. Use of Third-Party Services


Some features of the Platform require or offer optional connections to Third-Party Services, including:


  • analytics and monitoring tools
  • AI content generation
  • marketing, CRM, and email delivery tools
  • payment processors and billing providers
  • design, collaboration, and hosting infrastructure
  • domain registration, DNS, and SSL providers
  • social login integrations (e.g. Google)
  • forms, survey tools, and embedded scripts provided by third parties



When you enable, embed, or connect any Third-Party Service to your website or account, you acknowledge and agree that:


  • the Third-Party Service is governed exclusively by that provider’s terms and privacy policy;
  • Sitelium does not monitor, control, or assume responsibility for Third-Party Services;
  • your use of such Third-Party Services may involve the transfer of data to those providers;
  • you are solely responsible for reviewing and complying with the applicable third-party terms, privacy notices, and cookie rules;
  • Third-Party Services may place cookies, scripts, tags, analytics technologies, or similar tools on your websites, for which you are solely responsible toward your end users.


8.2. Sitelium’s role as technical facilitator


If you choose to use or integrate Third-Party Services through the Platform, Sitelium acts only as a technical facilitator. Sitelium does not:


  • control the functionality, accuracy, or availability of Third-Party Services;
  • become a party to any agreement between you and a third-party provider;
  • validate or audit the compliance of Third-Party Services;
  • assume liability for outages, breaches, data loss, or non-compliance caused by Third-Party Services.

Any issues, claims, or disputes arising from your use of Third-Party Services must be addressed directly with the relevant provider.



8.3. Responsibility for third-party scripts and code


If you add external code, widgets, tracking tools, marketing scripts, or integrations to your Sitelium websites, you are solely responsible for ensuring that such additions:


  • are lawful, secure, and technically compatible with the Platform;
  • do not harm or interfere with the Services;
  • do not violate privacy, cookie, consumer protection, or industry-specific laws;
  • are covered by proper disclosures, consents, or cookie banners required in your jurisdiction;
  • are removed or disabled if they create security risks or violate these Terms.
  • Sitelium does not provide support, auditing, or verification for any third-party code you choose to add.



8.4. Third-party outages and data loss


Sitelium is not responsible for:


  • downtime, errors, or service interruptions caused by Third-Party Services;
  • changes to third-party APIs, features, or pricing;
  • data loss, corruption, or unauthorized access occurring within Third-Party Services;
  • financial losses, reputational damage, or legal claims arising from your reliance on Third-Party Services.

To the maximum extent permitted by law, any warranties or assurances regarding Third-Party Services are expressly disclaimed.



8.5. Sub-processors and infrastructure providers


Sitelium uses a limited number of trusted sub-processors and infrastructure providers (such as AWS, payment processors, analytics vendors, and support tools) to deliver the Services. These are listed in our Privacy Policy and may be updated from time to time.


Sitelium ensures these providers are bound by data protection agreements consistent with GDPR and UK GDPR, but Sitelium cannot guarantee their performance or availability.


Your continued use of the Services constitutes acceptance of Sitelium’s current list of approved sub-processors.



8.6. Third-party links and external websites


The Services may contain links to third-party websites, platforms, or resources. Such links are provided for convenience only, and Sitelium does not endorse or control the content, policies, or practices of any third-party site. You access such sites entirely at your own risk.

THE SERVICES, AND THE INFORMATION ON OR AVAILABLE THROUGH THE SERVICES, IS PROVIDED ON AN “AS IS” BASIS WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITION OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE WEBSITE, WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE. You may not disclose Confidential Information to any third party, and you will protect Confidential Information in the same manner that you protect your own confidential information of a similar nature, using at least reasonable care. Confidential Information means nonpublic information that Sitelium or its affiliates or third parties designate as confidential or should reasonably be considered confidential under the circumstances, including software, specifications, and other nonpublic business information. Confidential Information does not include information that: (i) is or becomes generally available to the public through no fault of yours; (ii) you already possess without any confidentiality obligations when you received it under these Terms; (iii) is rightfully disclosed to you by a third party without any confidentiality obligations; or (iv) you independently developed without using Confidential Information. You may disclose Confidential Information when required by law or the valid order of a court or other governmental authority if you give reasonable prior written notice to Sitelium and use reasonable efforts to limit the scope of disclosure, including assisting us with challenging the disclosure requirement, in each case where possible.

We generally retain your personal data for as long as your account is active and for an additional 3 years after your account becomes inactive. To the fullest extent permitted by law, and except to the extent arising from our gross negligence or intentional misconduct, you agree to indemnify, defend, and hold harmless us, and our employees, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or rights of a third party. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with us in asserting any available defenses. You shall not settle any actions or claims on our behalf without our prior written consent.


If you are a California resident or resident of a state with a similar applicable law, you hereby expressly waive California Civil Code section 1542 in connection with the foregoing (or such other similar applicable law in your state), which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

You and Sitelium agree to resolve any claims relating to these Terms or our Services through final and binding arbitration, except that you have the right to opt out of these arbitration terms, and future changes to these arbitration terms, by emailing support@sitelium.com within 30 days of agreeing to these arbitration terms or the relevant changes.


We would like to understand and try to address your concerns prior to formal legal action. Before filing a claim against Sitelium, you agree to try to resolve the dispute informally by sending us notice at support@sitelium.com of your name, a description of the dispute, and the relief you seek. If we are unable to resolve a dispute within 60 days, you may bring a formal proceeding. Any statute of limitations will be tolled during the 60-day resolution process.


These Terms are governed by the laws of the United Kingdom. Any disputes not subject to arbitration shall be resolved in the courts located in London, England.

All communications shall be made in writing. We reserve the right to send notifications to you through the information supplied during registration or the email address associated with your utilization of the Services.

XVII. Changes to these Terms

19.1. United States


If you or your business is located in the United States:


You are responsible for complying with all federal, state, and local laws, including those related to data privacy, consumer protection, and online content.


You acknowledge and agree that Sitelium is a platform provider, and you are solely responsible for how you use the platform to collect, process, or share any personal data under US privacy laws such as the California Consumer Privacy Act (CCPA) or Children’s Online Privacy Protection Act (COPPA).


You must not use Sitelium to collect personal information from children under the age of 13, or under the age required by local law, without verified parental consent.


If you are subject to accessibility obligations under the Americans with Disabilities Act (ADA), it is your sole responsibility to ensure that your websites are accessible to all users.


Note: Certain disclaimers and liability waivers in these Terms may not apply to you depending on your state’s consumer protection laws.



19.2. United Kingdom (UK)


If you are located in the United Kingdom:


These Terms are governed by UK law, and you agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes not subject to arbitration.


You agree to comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 when using Sitelium to collect or process personal data.


If you are an agency creating websites for third parties, you are responsible for ensuring that those websites have adequate privacy notices, cookie banners, and data protection practices.


Consumers in the UK may have additional rights under the Consumer Contracts Regulations 2013, including cancellation periods for certain services. Where required, we will respect those rights.



19.3. European Union (EU)


If you are located in the European Economic Area (EEA):


These Terms are governed by EU law and the relevant national law of your country of residence unless otherwise agreed.


You agree to comply with the EU General Data Protection Regulation (GDPR) when using Sitelium Services. You are considered a data controller, and Sitelium acts as a data processor with respect to personal data processed via your websites.


You must implement appropriate privacy notices, obtain user consent for cookies (per ePrivacy Directive), and respond to user data access or deletion requests in accordance with GDPR obligations.


EU consumers may have the right to withdraw from a paid service within 14 days of purchase under the EU Consumer Rights Directive, and we will honor such requests in line with applicable law.

This Terms of Service (this “Agreement”, “Terms”) is between SITELIUM.COM (“we”, “us”, “System”, “Platform”, “Sitelium.com” or "Sitelium") and the person (“you”, “User” or “Customer”) using our services (“Services” or "Service").

We provide you with access to our System that helps you create websites, manage their content and customisation as well as hosting services. Listed below are the terms and conditions of using our Platform.


Creating an account

To create and account on our website you need to provide a name, email, and password and to agree to the terms and conditions listed below, Privacy Policy and our Data Processing Addendum.

You will be given a unique Sitelium URL for each of the websites you create on Sitelium. It is your responsibility to keep and maintain the safety of your account and password. If the information given by you is untrue, wrongful or in violation of our terms, we can suspend or terminate your account.

The email used for the registration of the account is considered the owner of the account and has the right to request assistance from us regarding the account on our support or email ticketing system.

You are solely responsible for the activities from your account, the maintenance and confidentiality of the credentials to access that account. You must immediately notify us if you know or have any reason to suspect that your Account or password have been stolen, misappropriated or otherwise compromised or in case of any actual or suspected unauthorised use

Your Content

You are responsible for any content that is in your website such as images, videos, audio files, design elements, logos, fonts, texts and more. We are not responsible for any of your content. We are also not responsible for content that has been lost because of the use of Sitelium, it is your obligation to safe keep and back-up your content regularly. We do not monitor what content has been used in a website and we are not to be held responsible for anyone breaking the terms and conditions, but we have the right to delete such harmful content or even terminate accounts if so.

You own all intellectual property associated with your account such as images, videos, audio files, design elements, logos, fonts, texts and any other materials and files created by you and existing on your website. You hereby grant Sitelium the non-exclusive, royalty-free, unalterable, interchangeable rights to your website content in order for Us to provide you with Sitelium’s Services.

We may choose to highlight or feature your website in our website for marketing or promotional purposes. You grant us a perpetual, worldwide, royalty-free, non-exclusive right and license to use any version of Your Sites, or any portion of Your Sites, including without limitation names, trademarks, service marks or logos on Your Sites, for the limited purpose of Sitelium marketing and promotional activities. For example, we may feature Your Sites on our Showcase page, or on our social media accounts. You waive any claims against us relating to any moral rights, artists’ rights or any other similar rights worldwide that you may have in or to Your Sites or names, trademarks, service marks or logos on Your Sites and any right of inspection or approval of any such use. You can opt out of being featured by contacting us at support [at] Sitelium.com This Section does not affect any rights you may have under applicable data protection laws.


Your Obligations

  • You need to be at least 16 years of age. People under the age of 16 are not permitted to use our services.
  • To keep your Sitelium account login information safe
  • To provide us with up to date, accurate and valid personal information at all times.
  • You own the rights to any content uploaded by you on your website, including images, videos, audio files, design elements, logos, fonts, texts and anything that you do have the rights to use.
  • The content materials can not be used in in an unlawful or harmful way.
  • You must notify us immediately if you become aware of any unauthorised use of your account.
  • Your content must not be illegal, unlawful, threatening, abusive, harassing, tortuous, vulgar or obscene in any way, must not infringe any person's legal rights.
  • You should not upload viruses, worms, Trojan horses or any other malicious code, files, or programs that may interrupt, destroy, or limit the functions and services of Sitelium.
  • You may not upload content that contains scam.
  • You may not try to hack, break or override the functions and stability of Sitelium or try to exploit the System in any way.
  • You may not use the System to create any scam websites and promotions with misleading content that can harm or scam visitors.
  • You may not use Sitelium for distributing, storing or, in any way, using the System for pornographic or adult content and services.
  • You represent and warrant that your use of the Services is not contrary to law, including without limitation applicable export or import controls and regulations and sanctions.
  • You can’t in any way try to harm the reputation of Sitelium and their partners by leaving harmful comments, untrue and misleading information about the product or any sort of intentional damage to the reputation of Sitelium.
  • You acknowledge and agree that if you are reasonably found guilty of violating of any of these rules and obligations, this may cause immediate termination of your account with no refund for the services that have already been paid for. You may also be forbidden from having a Sitelium account in the going forward.


Third Party Services

Our Services are integrated with various third party services (“Third Party Services”) for specific purposes that you may interact with while using Sitelium. Example for such services is the Payment Processor used to collect the payments for your subscriptions. These Third Party Services may have their own terms and policies, and your use of them will be governed by those terms and policies. We don't control Third Party Services, and we’re not liable for Third Party Services or for any transaction you may enter into with them, or for what they do. Your security when using Third Party Services is your responsibility. You also agree that we may, at any time and in our sole discretion, and without any notice to you, suspend, disable access to or remove any Third Party Services. We’re not liable to you for any such suspension, disabling or removal, including without limitation for any loss of profits, revenue, data, goodwill or other intangible losses you may experience as a result (except where prohibited by applicable law).


User Content

The sites created using Sitelium may contain user content that is in violation of the permitted usage of the platform (Your Obligations). We do not endorse or support such content. We’re not a publisher of, and we’re not liable for, any User Content uploaded, posted, published or otherwise made available via the Services by you or other users. You're responsible for taking precautions to protect yourself, and your computer or network, from User Content accessed via the Services. Any such content detected or reported to us will be removed as a violation of the allowed usage of the Services.


Sitelium & our rights

Sitelium provides a website building system, templates (themes), website hosting from third party companies, CDN services from third party companies. The images used for the creation of the mockup themes are released under Creative Commons CC0. Sitelium does not hold any rights to images used for the creation of the themes.

We have the right to change parts or all of the services and functionalities at any given time, to remove or suspend parts or all of the services and functionalities, we have the right to suspend and terminate access of your Account to parts or all of the services and change the eligible criteria of using the Services.

HTTPS certificates are issued to any published website on Sitelium. You do not have an option to disable the HTTPS certificates, they are assigned automatically to any new domains connected to Sitelium.


Free trial account

Sitelium provides the option to create a Free Trial account, and you can use the services according to the agreement. The free trial account lets you, the User, test and create a website to your liking before committing to a paid subscription. Sitelium has the right to terminate or cancel free trial accounts at any time for any reason. We can delete the content of any free trial website without notice. We are not in any way to be held responsible for any deleted content from a website built on Sitelium.


Fees

  • All Fees are in USD, EUR or GBP and don't include taxes that you are responsible of paying based on your country's tax rate. Sitelium is not liable for any taxes or fees related with commercial products.
  • The payment for the applicable fee is in advance of your subscription period according to the Agreement.
  • You can upgrade or downgrade at any time from your Sitelium account. If upgrading, you will be charged the difference between the two subscription plans for the extra services.
  • Refunds are allowed only for yearly subscriptions and up to 14 days after the subscription is made.
  • At the end of a contract term, the services will be automatically renewed for the same period of time until EXPLICITLY canceled by the User or Or request cancellation to support by user. Cancellation must be made from your Sitelium account under Payments and at least 24 hours prior to the end of the contract period.
  • If you purchase Sitelium subscription services, you agree to Sitelium and third party services to use and store your credit/debit card information. You authorise us to charge you for any Sitelium Services that you may purchase and any applicable taxes connected with the payment card services.
  • You are responsible for the fair usage of your website.
  • Chargebacks - If you contact your bank or credit card company to decline, chargeback or otherwise reverse the charge of any payable fees to us (“Chargeback”), we may automatically terminate your Account. We reserve our right to dispute any Chargeback.


Cancellation

Failure to comply with any of Sitelium’s terms or pay due fees you entitle Sitelium to cancel or suspend your account services and website.


You can request the cancellation of your subscription at any time, no questions asked. We are not in any way held responsible for any damages and losses due to the cancellation of subscriptions. (Important: When you cancel your plan, you will lose access to your storage, data, and all PRO features associated with your subscription.)


Inactive

An inactive Sitelium Account has not been used for 6 months (180 days). Sitelium reserves the right to delete an inactive Sitelium Account.


This policy applies to your FREE Trial Sitelium Account. This policy doesn't apply to any PRO Sitelium Account.


We encourage people to log in and use Sitelium to keep their accounts active after creating an account.


When your Sitelium Account has not been used within six months (180 days), your Sitelium Account is considered inactive, and all of its content, data, and account will be permanently deleted without any notice.



Termination

We reserve the right to change, suspend or discontinue, or terminate, restrict or disable your use of or access to, parts or all of the Services or their functionality at any time at our sole discretion and without notice.

You can terminate your services at any time without a cause according to the cancellation procedures. If the Agreement terms are violated it may result in penalties or immediate termination of services without payment refund.

Upon termination Sitelium has the right to delete all files, data or information associated with the terminated account.


Domains

We don't sell custom domains. If you don't have a custom domain, buy one from any domain registrar. Please note that IDN domains (domains that contain special characters) are not yet supported in Sitelium.


Warranty & Disclaimer

Sitelium shall use reasonable efforts consistent with prevailing industry standards to maintain the Services in a manner which minimises errors and interruptions in the Services and shall perform the Implementation Services in a professional and workmanlike manner. Services may be temporarily unavailable for scheduled maintenance or for unscheduled emergency maintenance, either by Sitelium or by third-party providers, or because of other causes beyond Sitelium’s reasonable control, but Sitelium shall use reasonable efforts to provide advance notice in writing or by e-mail of any scheduled service disruption. HOWEVER, SITELIUM DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES. EXCEPT AS EXPRESSLY SET FORTH IN THIS SECTION, THE SERVICES AND IMPLEMENTATION SERVICES ARE PROVIDED “AS IS” AND SITELIUM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.


Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Sitelium and its affiliates and its and their directors, officers, employees and agents from and against all damages, losses, liabilities, costs, claims, demands, fines, awards and expenses of any kind (including without limitation reasonable attorneys' fees and costs) arising out of or related to: (a) your breach of this Agreement; (b) your User Content, Your Sites; (c) any claims by, on behalf of or against your End Users; (d) your violation of any law or regulation or the rights or good name of any third party; and (e) any claims from tax authorities in any country in relation to Your e-commerce operations, including without limitation your sales to individual consumers (including distance sales) and other operations for which Sitelium may be held jointly and severally liable. Your indemnification obligations under this Section shall not apply to the extent directly caused by our breach of this Agreement or, where you are an EU Consumer, to the extent that the consequences were not reasonably foreseeable.


Limitation of liability

You acknowledge and agree that to the fullest extent permitted by applicable law, in no event will Sitelium and its affiliates and its and their directors, officers, employees and agents be liable with respect to any claims arising out of or related to the Services or this Agreement for: (a) any indirect, special, incidental, exemplary, punitive or consequential damages; (b) any loss of profits, revenue, data, goodwill or other intangible losses; (c) any damages related to your access to, use of or inability to access or use parts, some or all of your Account, Your Sites or parts or all of the Services, including without limitation interruption of use or cessation or modification of any aspect of the Services; (d) any damages related to unavailability, degradation, loss, corruption, theft, unauthorised access or, unauthorised alteration of, any content, information or data, including without limitation User Content and Your e-commerce data; (e) any User Content or other conduct or content of any user or third party using the Services, including without limitation defamatory, offensive or unlawful conduct or content; or (f) any Third Party Services or third party sites accessed via the Services.

You acknowledge and agree that these limitations of liability are agreed allocations of risk constituting in part the consideration for Sitelium’s services to you, and such limitations will apply even if Sitelium has been advised of the possibility of such liabilities.


Modifications

Sitelium may make modifications and changes on the existing services or components and will use reasonable efforts to notify all its Customers about those changes. The changes are effective upon the date of the change. Sitelium shall not be liable for modifications and actions of third party services.

Modifications to the Agreement and the Fees may occur. You will be notified prior to those changes being applied to your account. If you refuse or fail to pay such fees we will cancel your subscription.


Miscellaneous

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. This Agreement is not assignable, transferable or sub-licensable by Customer except with Sitelium’s prior written consent. Sitelium may transfer and assign any of its rights and obligations under this Agreement without consent. This Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Agreement, and that all waivers and modifications must be in a writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of this Agreement and Customer does not have any authority of any kind to bind Sitelium in any respect whatsoever. In any action or proceeding to enforce rights under this Agreement, the prevailing party will be entitled to recover costs and attorney’s fees. All notices under this Agreement will be in writing and will be deemed to have been duly given when received, if personally delivered; when receipt is electronically confirmed, if transmitted by facsimile or e-mail; the day after it is sent, if sent for next day delivery by recognised overnight delivery service; and upon receipt, if sent by certified or registered mail, return receipt requested. This Agreement shall be governed by the United Kingdom laws without regard to its conflict of laws provisions.
